Think Differently: Reimagining Legal Costs in a Rising-Rate Environment

In my conversations with general counsels across the country, one concern consistently rises to the top: the relentless climb of litigation costs. With top law firms seeing an 8.4% rate increase in 2023 and midsize firms not far behind at 5.6%, the pressure on legal budgets has never been more intense. Hourly rates between $700 and $1200 are now standard in major cities.
But what if we're thinking about this challenge all wrong?
Remember Billy Beane and the Oakland A's? They revolutionized baseball by focusing on undervalued statistics like on-base percentage while others chased flashy stats like home runs. Billy Beane's Oakland A's generated nearly as many wins as the championship Yankees at roughly one-third of the payroll. We can apply similar principles to legal services.
Consider this: Many GCs are paying premium rates for national coordinating counsel to handle multi-state litigation. Yet respected regional firms can often handle mid-range cases ($50,000 to $5 million) just as effectively at local rates, especially for arbitration or actions that don't involve bet-the-company litigation.
Here's another approach: Transform your legal department from a cost center into a value generator. With the right strategy, written-off debts can become a source of recovered revenue through pre-litigation measures like strategically deployed demand letters.
Complex litigation requires a thorough evaluation of scope, risk, and strategy. The key is finding a litigation team that brings both expertise in case assessment and efficient execution while maintaining the flexibility to address challenges that arise.
